1. Description of Service
Property Owner Check is a web-based platform that provides property owner contact information, including names, phone numbers, and email addresses, by searching public records and third-party data sources. The Service offers single-address lookups and bulk CSV uploads.
2. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You must be at least 18 years old to create an account.
- You must provide a valid email address and company name.
- You are responsible for keeping your password secure.
- You must notify us immediately of any unauthorized use of your account.
3. Credits and Payments
The Service operates on a credit-based system. Each property lookup consumes one credit. Credits can be purchased as one-time packs or through monthly subscriptions.
- Credits from one-time packs do not expire.
- Subscription credits are allocated monthly and do not roll over to the next billing cycle unless specified.
- All payments are processed through Stripe. We do not store your payment card details.
- Prices are listed in US dollars and are subject to change with 30 days' notice.
4. Refund Policy
Due to the nature of the Service (instant data delivery), refunds are generally not available for consumed credits. If a lookup returns no results, no credit is charged. For subscription cancellations, you retain access until the end of the current billing period.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the Fair Debt Collection Practices Act (FDCPA), and the CAN-SPAM Act. You may not:
- Use the data for harassment, stalking, or any illegal purpose.
- Resell, redistribute, or sublicense the data obtained through the Service without prior written consent.
- Attempt to reverse-engineer, scrape, or programmatically extract data from the Service beyond the provided interface.
- Use automated tools, bots, or scripts to access the Service except through the provided bulk upload feature.
- Misrepresent your identity or the purpose of your data requests.
6. Data Accuracy
We strive to provide accurate and up-to-date information, but we do not guarantee the accuracy, completeness, or timeliness of any data returned. Property ownership and contact information may change, and public records may contain errors. You use the data at your own risk.
7. Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy. We collect and process personal data as necessary to provide the Service, including your email address, company name, and usage history.
8. Intellectual Property
The Service, including its design, code, text, graphics, and logos, is owned by us and protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless propertyownercheck.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited upon termination for cause.
12. Changes to Terms
We may modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
